Terms
Using this site
These terms cover the use of the Hexalo Design Studio website and the basis on which the studio takes on projects. By using the site you accept them.
Our content
The texts, images, palettes and layout of this site belong to Hexalo Design Studio unless stated otherwise. You may read them, link to them and quote short extracts with credit. Copying the designs or presenting them as your own needs our written consent. The images in the gallery are illustrative palette and material studies, not client work.
Prices and quotations
Prices on this site are starting points in Japanese yen and exclude consumption tax. The price of a project is a fixed amount for a defined scope, set out in a written proposal after the discovery session. Prices on the site may be updated before the page is; the figure in your proposal is the one that applies.
No spec work and the discovery session
The studio does not pitch ideas for free. Every project begins with a paid discovery session, so that the work is grounded in your real situation. The fee for the session is stated before it is booked and is credited against the project fee if you go ahead, unless the proposal says otherwise.
Scope, rounds of feedback and changes
The proposal names the deliverables, the timetable and the number of structured rounds of feedback. Work beyond that scope, such as a further round or an additional format, is quoted separately before it is done. Delays in feedback or in supplying material move the timetable by the same amount.
Ownership and licences
Once the invoice for a project has been paid in full, the client owns the final approved artwork and may use it for the purposes named in the proposal. Rough concepts, rejected routes and working files remain with the studio unless the proposal says that working files are included. Moral rights remain with the designer in every case.
Typefaces, stock images and other third-party material carry their own licences. The studio will tell you which licences a project needs, and who buys them, before the work is finished.
Portfolio and credit
The studio may show finished work in its portfolio only with the client's agreement, which we will ask for in writing. A client may ask for a piece to be left out or taken down at any time.
Payment
Invoices are issued in Japanese yen with consumption tax shown separately. The proposal sets the schedule, which usually includes a deposit before work starts and a balance on delivery. Final files are released when the balance has been paid.
Cancelling a project
If a project is stopped part-way, the client pays for the work completed up to that point. The proposal states how that is calculated; we do not apply a fee that it has not named.
Limits of responsibility
We are responsible for this site's content and for our services as the law requires. A designer cannot check every legal aspect of a name or a mark: clients should take advice on trademark registration before they commit to a new identity. We are not liable for external sites we link to. Nothing in these terms limits liability that cannot lawfully be limited.
Changes to these terms
The studio may amend these terms. The text on this page is always the current version, and if you keep using the site after an amendment you are taken to accept it.
Governing law and courts
These terms and any dispute arising from them are governed by the laws of Japan. The Osaka District Court has exclusive jurisdiction in the first instance, unless mandatory law provides otherwise.
